Trademark registration

Adequate business protection is impossible these days without trademark registration. At ecommerce.legal, we understand this, which is why we offer our clients comprehensive assistance in intellectual property matters.

Our services include full brand (trademark) rights verification and purity testing. This review determines whether there are any legal obstacles to obtaining trademark protection. We then support the client throughout the entire trademark protection process—from filing a trademark registration application to issuing a protection certificate by the appropriate office.

We also assist our clients in obtaining grants for trademark registration. Our lawyers are listed as providers of the IP SCAN service – an intellectual property (IP) pre-screening service that is part of the European SME Fund program, designed to help micro, small, and medium-sized enterprises (SMEs) access intellectual property protection and strengthen their businesses. Support is provided by the European Union Intellectual Property Office (EUIPO). The IP Scan service is subsidized for up to 90% of its cost.

We also support clients who have already registered their trademarks, advising on trademark infringements and unfair competition cases. To this end, we conduct negotiations, pre-trial proceedings, and court proceedings.

What exactly is a trademark?

A trademark can be any sign that distinguishes the goods of one company from those of another. A trademark can include, in particular, words, graphics, logos, as well as sounds or multimedia.

Trademark and brand

A brand is a marketing concept comprised of a number of elements, such as a name, logo, and other company-specific features. A trademark is a narrower concept, often constituting a significant element of a brand (e.g., a logo).

The essence of a trademark

A trademark is a business asset. A trademark can be valued and traded. The immense value of a trademark is demonstrated by examples of the world's largest brands – for example, in 2024, Apple's logo was valued at $214 billion, and Coca-Cola's at $66 billion. These examples demonstrate how a simple logo can have a significant impact on business.

The duration of the trademark protection right

Trademark protection is granted for 10 years from the date of filing with the Patent Office – protection may be extended without restrictions for subsequent 10-year periods.
